How long will my personal injury case take?

There are many factors as to when we will know the full extent of your entry and the full value of your case, and then we can attempt to negotiate a settlement for you.

We need to know the full extent of your injury to resolve your case. To do that, you’ll have to get to the point of maximum medical improvement (MMI). MMI means nothing else can help you recover from your injuries.

Your case will resolve at the point where you’re completely recovered or until we know what you will need for the future.

So, if we can get to a point where your doctor has said, “this is as good as it gets,” or “this is what I recommend for the next three months… in the next six months,” we can gather the evidence and send it to the insurance company. In doing so, we’re telling the insurance company what you will need due to this crash. We can ask for future medical care to be taken into consideration.

How long does it take to get a personal injury settlement?

A settlement means we know the final number and have reached an agreement with the insurance company, and they’re sending a check. We can reach a settlement when we’ve reached the policy limits for the at-fault party’s case or when we reach an agreement that you accept. If we can’t reach a settlement in this phase, we go into litigation. One moving to litigation, we could reach a settlement with or without a trial.

How much will it cost me to hire a personal injury attorney?

How do you calculate pain and suffering?

As personal injury attorneys, we draw on our experience in settling these types of injuries in the past. Insurance companies draw on what they have settled in these types of injuries for in the past.

We’re trying to foresee what a jury might do with your case. So, this gives us the range of where the insurance company is coming from and where my recommendations would come from.

We then consider factors unique to you outside of that range—what was your personal experience, what this means to you, your family, your career, your future, and where you’re at in your life. These things are unique to you and your case.

We use the factors unique to you to negotiate a higher compensation within or outside the range for those types of injuries and treatment.

What is my personal injury case worth?

We take into account three categories of damages to determine the value of your case.

The first is economic damages. Economic damages are the most straightforward category of damages to calculate. They are anything you can put a dollar sign in front of. It includes medical bills, past and future lost wages, and any other out-of-pocket expenses for treatment.

The next category is non-economic damages. Non-economic damages include personal injury and pain and suffering. They also include inconveniences, loss of enjoyment of life, and intangible things related to your injury claim besides just having to pay a medical bill.

The third category is impairment. Impairment is not a part of all personal injury cases. If some part of your body was injured and will not ever be the same, that is impairment. We need to know whether the impairment will require future medical treatment or how that impairment is going to impact the rest of your life. If impairment is part of your case, we need you to get the most appropriate treatment for you as well as the best evidence for us to pursue your claim.

Pain and suffering are limited from the day of the car crash to the day you are done with treatment. If you don’t have any impairment, the economic damages and the non-economic damages are within a finite period, and you are fully recovered, we can more easily determine the value of your case based on those two categories. But the potential impairment piece for your case is more of an unknown and has a bigger determination on the value of the claim.

When is a personal injury lawyer necessary?

Hiring a personal injury lawyer is a personal choice. If you’re deciding whether to hire an expert to handle your case, it’s important to feel a sense of trust that they’ll work to get the most favorable outcomes for you.

How does insurance work? Should I just contact my insurance company?

Things get complicated quickly when the at-fault party’s insurance and your insurance are involved. Depending on the nature of your injuries and the treatment you might need, health insurance may also be in the mix. A strategy for using the different types of insurance coverage available to you gives you the best chance at a full recovery. In addition, it gives you some compensation that you might need right now to take care of out-of-pocket expenses and lost wages.

How do you prove my injury case?

Your case is dependent upon the evidence. Evidence is everything from your testimony about the crash and what you are going through as a result. Testimony may be about pain and suffering and the effects this injury has had on you, your family, and your work.

We also look at other objective evidence, which includes your medical records. These records will have notes from your doctors, physical therapists, and other providers about your treatment. For example, information may consist of physical limitations you’re experiencing, pain level, and then recommendations from the medical providers about what treatment you need.

These medical records and objective testing would include X-rays, MRIs, and other imaging.

But there are different kinds of objective testing depending on what injuries we’re looking at with your case.

Insurance companies put a lot of stock in objective testing as opposed to subjective comments that you make that your medical providers make about your recovery coverage.

And then, if we need to, we can go outside and your medical providers and retain experts as needed to explain further and provide evidence for the extent of your injuries or the cause of your injuries, or what you might need for the future.

What if I think I am at fault for my accident?

Just because a citation is issued doesn’t mean the case is set. If a citation was issued for the crash, it does not necessarily mean that a jury would find that person at fault or that an insurance company would find that person at fault.

We’ve helped many people who were issued a citation that got dismissed, and the insurance company found them not at fault or where the other driver was issued a citation at the scene, and then the person’s insurance later denied liability.

We’ll talk about liability, what other evidence there is for your case, whether there are witnesses and the laws for this type of traffic accident. Then, after reviewing all of these details, we’ll make a recommendation on your case.

What should I bring with my to my first meeting with an injury lawyer?

Bring any materials and information you already have related to your case. If you’ve already received bills in the mail, bring those. You should also bring a copy of the accident report and pictures of the crash from your cell phone. If you have pictures of your injury, bring those, too. We’ll go through it bill by bill and category by category to review all of this information for your case.

What should I expect on my first meeting with my personal injury attorney?
